- Conducting
searches to determine the availability of proposed trademarks,
service marks and domain names and rendering opinions as to
their availability and registrability.
- Preparing
and prosecuting applications for trademark and service mark
registration at both the federal and state levels, including
appeals to the Trademark Trial and Appeal Board and to the United
States Court of Appeals for the Federal Circuit.
- Prosecuting
and defending opposition and cancellation proceedings before
the Trademark Trial and Appeal Board.
- Implementing
programs for the international registration and protection of
trademarks and service marks.
- Enforcing
trademark, service mark, domain name and trade name rights,
including domestic and foreign vigilance services to detect
infringement and obtaining compliance from infringers through
negotiation or, if necessary, litigation.
- Recording
trademark registration with the United States Customs Service
and implementing programs to bar importation of counterfeit
and unlawful "gray market" goods.
- Exploiting
the commercial value of trademarks, service marks and related
merchandising rights, including negotiation and preparation
of license and franchise agreements.
